These Terms of Service govern your use of the FaradayMind API service ("the Service"). By subscribing, you agree to these terms. Please read them carefully.

FaradayMind provides access to a private AI language model inference API hosted on UK-based hardware. The Service is provided via a REST API accessible using your unique API key.
The Service is provided on a monthly subscription basis. Fees are as set out on the pricing page at the time of your subscription. Invoices are issued monthly in advance. Payment is due within 14 days of invoice. We reserve the right to suspend access for overdue accounts.
Prices may be updated with 30 days' written notice. You may cancel before the new price takes effect.

We reserve the right to suspend or terminate access without notice where we believe a material breach of these terms has occurred.
Your API key is confidential. You are responsible for all requests made using your key. If you believe your key has been compromised, notify us immediately at hello@faradaymind.com and we will issue a replacement.
We will use reasonable efforts to maintain availability of the Service. However, we do not guarantee any specific uptime. The Service may be unavailable during maintenance, updates, or due to factors outside our control. We are not liable for losses arising from downtime.
Where you submit personal data through the API, you remain the data controller. FaradayMind acts as a data processor. A separate Data Processing Agreement (DPA) governs this relationship and is available at faradaymind.com/dpa. You are responsible for ensuring you have a lawful basis for submitting any personal data to the Service.
To the fullest extent permitted by law, FaradayMind's total liability to you in connection with the Service shall not exceed the total subscription fees paid by you in the three months preceding the event giving rise to the claim.
We are not liable for indirect, consequential, or incidental losses, including loss of profits, loss of data, or reputational damage.
AI-generated outputs are not professional advice. You are responsible for reviewing outputs before relying on them for legal, financial, or other professional decisions.
Either party may terminate the subscription with 30 days' written notice. On termination, your API access will be revoked at the end of the current billing period. We will delete your account data within 30 days of termination, subject to any legal retention obligations.
We may modify the Service, including the models available, with reasonable notice. Where a change materially reduces the functionality of your plan, you may terminate without penalty.
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
